SARS Goes After Advisors

How Tax Practitioners, Lawyers, and Accountants May End Up Liable for their Clients' Tax Debts

The Supreme Court of Appeal has backed Commissioner Kieswetter and issued a stern warning to all South Africans to refrain from assisting others in evading their tax obligations. Where you are caught, SARS may go after you personally. It is now settled law in South Africa and directors or companies, tax advisors, lawyers, accountants, or even payroll professionals could find themselves on the hook.

A recent judgement, Christoffel Hendrik Wiese and Others v CSARS, illustrates how the Supreme Court of Appeal (“SCA”) enforces the regulations of the Tax Administration Act, No. 28 of 2011 (“TAA”), demonstrating there is no escape for those who facilitate the dissipation of a taxpayer’s assets where a debt is due to SARS.

Understanding the judgement handed down by the SCA is crucial for all Tax Practitioners, Lawyers, Accountants and all financial advisors in the financial services industry.
