After UMK – when can you seek relief at the High Court?
The Constitutional Court’s decision in United Manganese of Kalahari et al v CSARS (UMK) replaced the “exceptional circumstances” threshold for approaching the High Court in tax matters with a “good cause” standard.
This webinar examines what that shift means in practice: when the High Court has jurisdiction, when the Tax Court is the exclusive forum, what SARS decisions can be reviewed and the process of review, and what post UMK CC case law have decided, including the SCA’s decision in Henque and the High Court decisions in Kerbyn, Prinsloo, and Ferreira v CSARS.
